Terms and Conditions

1. Introduction
These Terms and Conditions govern your use of the Lift Holdings Customer Application ("Lift App") operated by Lift Holdings (Pvt) Ltd ("Lift Holdings"). By registering and using the Lift App, you ("Passenger" or "Customer") agree to be bound by these Terms and Conditions. If you do not accept these Terms in their entirety, you must immediately stop using the Lift App.
2. Description of the Service
Lift Holdings provides a technology platform (the "Service") through which Passengers can access and order taxi services provided by independent Drivers in various locations, subject to availability. The Service is available via the Lift App and through https://www.lifttaxi.lk.
The Service is offered without cost to the Passenger, except where local law or regulation provides that taxis ordered via the internet must levy a surcharge. Lift Holdings may also offer the option to pay electronically via Lifttaxi Payment; separate terms and conditions will apply to such transactions.
3. Important Disclaimer
Lift Holdings performs no Driver selection. The data provided for each Driver (vehicle model, plate number, full name, profile picture) is provided solely by the Driver. Lift Holdings has no involvement in the contractual relationship between Driver and Passenger.
4. Acceptance of Terms
By registering for and/or using the Service, the Passenger agrees to all Terms contained herein. Lift Holdings reserves the right to change these Terms at any time. Where changes are made, Lift Holdings will notify the Passenger via email or in-app notification prior to the change taking effect. Continued use of the Service after any change shall constitute the Passenger's acceptance.
5. Licence Grant
Subject to continued compliance with these Terms, Lift Holdings grants the Passenger a limited, non-exclusive, non-transferable, and revocable licence to access and use the Lift App for personal, non-commercial purposes only (the "Licence"). All rights not expressly granted are reserved by Lift Holdings.
This Licence does not permit the Passenger to:
- Use the Lift App for any purpose other than personal, non-commercial use, or in any manner contrary to applicable law or these Terms.
- Authorise or allow any third party to use or access the Lift App via the Passenger's account.
- Sub-licence, sell, transfer, distribute, or otherwise assign the Licence.
- Reverse engineer, decompile, modify, disassemble, or create derivative works based on the Lift App.
- Use automated tools such as bots, crawlers, or scrapers to extract data from the Lift App.
- Frame, mirror, or link to any part of the Lift App on another website or system.
- Post or transmit content that is unlawful, defamatory, false, deceptive, or constitutes spam or unsolicited communications.
6. Customer Registration
To access the Service, the Passenger must register with Lifttaxi and must be at least 18 years of age. By registering, the Passenger agrees to:
- Provide accurate, truthful, and complete registration information (including full name, address, telephone number, email address, username, and password).
- Keep registration information accurate and up-to-date at all times.
- Be solely responsible for all activity that occurs on the Passenger's account.
- Maintain the confidentiality of their Lifttaxi password and not share it with any third party.
- Never use another User's account without prior express permission.
- Immediately notify Lift Holdings in writing of any unauthorised use of the account or any other security breach.
7. Booking and Cancellation
The following cancellation policy applies to Passengers:
- The Passenger may cancel a booking within 5 minutes of the Driver accepting the trip without incurring a cancellation fee.
- A cancellation fee will be charged if the Passenger cancels after 5 minutes of the Driver accepting the hire.
- A cancellation fee will be charged if the Passenger cancels after the Driver has already arrived at the pick-up location.
- The cancellation fee will be waived if the Driver fails to reach the Passenger's pick-up location within a reasonable time.
- If the Passenger fails to be present at the pick-up location, or the Driver cannot reach the Passenger within a reasonable time, the Driver may cancel the hire and the cancellation fee will apply to the Passenger.
8. Payment Conditions
The Passenger is required to pay the full fare along with any applicable parking charges, night surcharges, and waiting charges. The fare for a given trip:
- Will be notified to the Passenger via the Lift App prior to confirming the trip.
- May vary depending on prevailing demand, distance, duration, applicable tolls, and other factors. Surge or dynamic pricing may apply during periods of high demand and will be disclosed in the App before the trip is booked.
- Will, unless otherwise indicated, include any applicable service, booking, or administration fees.
Approved payment methods include Cash, Credit/Debit Cards, Easy Cash, QR Codes, and any other method approved by Lift Holdings from time to time.
Where the Passenger pays by credit or debit card, the Passenger represents and warrants that they are the authorised user of such card. Any fees paid by card shall be final and non-refundable, except where otherwise specified in these Terms.
9. Passenger Conduct
9.1 General Obligations
- Treat the Driver and the Driver's vehicle with respect and courtesy at all times.
- Not damage or remove any parts of the Driver's vehicle.
- Abide by all road safety rules and regulations of Sri Lanka.
- Comply with all Sri Lankan laws governing the transportation of Passengers with disabilities.
9.2 Prohibited Conduct
- Engaging in any sexual conduct or violence while using the Service.
- Permitting or consuming illegal substances in the vehicle (unless explicitly permitted by law).
- Engaging in or facilitating human trafficking of any kind.
- Requesting or directing the Driver to violate any applicable law or regulation.
- Accessing, using, or sharing personal data of any Driver for any purpose other than personal use of the Service.
9.3 Driver Under the Influence
If a Passenger believes a Driver may be under the influence of drugs or alcohol, the Passenger shall immediately request the Driver to end the trip and notify Lift Holdings through the App.
10. User Content
The Passenger may be permitted to upload content such as ratings, reviews, and comments ("User Content"). The Passenger represents and warrants they are lawfully entitled to submit such User Content and grants Lift Holdings a worldwide, irrevocable, royalty-free licence to store, use, and disclose such User Content for the purposes of operating and improving the Service.
11. Emergencies
- Immediately call the relevant emergency service number.
- Use the 'Emergency' option available on the Lift App to alert Lift Holdings.
- Once all parties are safe and the situation has been handled by the authorities, notify Lift Holdings promptly.
12. Intellectual Property Rights
All content in the Lift App (logos, symbols, designs, names, images, software, source code, and databases) is owned by or licensed to Lift Holdings and is protected by copyright, trademark, patent, and other applicable laws. The Passenger may not reproduce, modify, distribute, or exploit any content for commercial purposes without prior written permission from Lift Holdings.
13. Suspension and Termination
Lift Holdings may, at its sole discretion and without prior notice, suspend or terminate the Passenger's account. Violations of these Terms may result in suspension or permanent loss of the Passenger's account. If the Passenger wishes to terminate their account, they may do so via Profile Settings within the Lift App, or by contacting Lift Holdings using the details in Section 20.

15. Indemnification
The Passenger agrees to defend, indemnify, and hold harmless Lift Holdings, its affiliates, employees, contractors, directors, suppliers, and representatives from all losses, costs, actions, claims, damages, and expenses that arise from the Passenger's use or misuse of the Service, violation of these Terms, or infringement of any intellectual property or other right of any person.

17. Privacy and Data Protection
Lift Holdings processes personal data in accordance with applicable data protection laws, including the Personal Data Protection Act No. 9 of 2022 of Sri Lanka (as amended). The collection, storage, and use of the Passenger's data is governed by the Privacy Policy of Lifttaxi, available at https://www.lifttaxi.lk/privacy.
The Passenger must immediately notify Lift Holdings in writing upon becoming aware of any unauthorised access, loss, alteration, or disclosure of personal data connected to their account.
18. Links to Third-Party Websites
The Lift App may include links to third-party websites. Lift Holdings is not responsible for the content, privacy policies, or practices of any third-party sites. The Passenger accesses any such platforms at their own risk.
19. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Democratic Socialist Republic of Sri Lanka. The courts of Sri Lanka situated in Colombo shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms.

21. Severability
If any provision of these Terms is held to be illegal, invalid, or unenforceable under applicable law, whether in whole or in part, such provision shall be deemed severable from the remaining Terms. The remaining Terms shall continue in full force and effect.
